The Division of Waste Management proposed an amendment to administrative regulation 401 KAR 39:120. The amendment would change the existing administrative regulation by establishing a fee schedule for the review and determination of hazardous waste permit applications.


The cost to comply would potentially increase by $300 per year for "very small quantity generators" as they would no longer be exempt from annual registration fees. KPMA took issue with this registration fee that would potentially be assessed on businesses generating in any single calendar month between 220 and 2,200 pounds of non-acute hazardous waste. 


KPMA opposed this proposed amendment and RTAC Chairman Mark Sweet of Shield Environmental testified as such on the KPMA's behalf at a public hearing in Frankfort on Thursday, Aug. 24. Also in attendance was RTAC member Danielle Smith of Lykins Energy.
