Terms and Conditions

1. Owenership of the webpage join.acp.pt 


The webpage join.acp.pt is owned by the Automobile Club of Portugal ("ACP"), a private corporation, deemed of public utility, headquartered at Rua Rosa Araújo 24-26, in Lisbon, NIPC (Corporate Tax Identification Number) 500 700 800 and registered at the Board of Trade of Lisbon under the same number.



2. Object and Scope


These terms and conditions (hereinafter collectively referred to as "Conditions") set out the rules for accessing and using the Automobile Club of Portugal webpage join.acp.pt (hereinafter "Webpage"), hence, when you access it you agree to the terms described below.


If you have any reservations, doubts or objections regarding the Conditions, you should immediately suspend access to and use of the Website, leave the Website and abstain from using it.


The ACP reserves the right to change, add or delete the Conditions, without prior notice, said changes producing their effects, after we make them available on the Webpage.



3. General Conditions of Use


When you use the Webpage, you undertake to, namely:

a) Respect the copyrights and intellectual property rights of ACP;


b) Make a correct and adequate use of the Website and its contents, in accordance with the present Conditions, refraining from any use that could be deemed harmful to ACP or any third party;


c) Not to modify the Website software, with the purpose of obtaining unauthorized access to any of its contents.


ACP reserves the right to monitor the use of the Webpage in order to detect any improper use and to monitor compliance with these Conditions.


The Webpage contains texts, comments, messages, information, graphics, photographs, informative articles, illustrations, software, audio and video (which are referred to as "contents") that can only be accessed and used upon acceptance without restrictions of these Conditions.


The contents and websites redirected by the Webpage through links, belong, are licenced and/or are made available in an authorized manner by ACP.


By accessing third-party websites through links made available on the Webpage, you do so at your own risk, and no liability can be assigned to ACP, regarding the contents available therein and damages that you may suffer from anomalies, namely viruses, caused by access to those websites.


You must use the third-party websites responsibly, taking into account, in particular, their privacy policies or general terms and conditions or use of services.


The use and access to third-party websites is solely of the the user´s responsibility and at own risk.



4. Content


ACP authorizes you to access and use the Webpage contents exclusively for personal purposes, as well as authorize the creation of links to the Webpage, without the express consent of ACP being required, as long as those links give rise to the opening of a new browser window, through which the link to the Webpage is explicitly indicated, thus avoiding confusion between the Webpage and other users' websites.


Reproduction, transfer, distribution, copy or storage of content by you for any purpose other than strictly personal, including commercial purposes, without the prior written permission of the ACP is expressly forbidden.


Notwithstanding the provisions of this section, any modification, copying, distribution, transmission, publication, licence or creation of new contents based on those available on the Webpage is strictly forbidden, regardless of its nature and its purposes, which belongs, on the whole or in part, to the contents of the Webpage, without prior written authorization from ACP.


ACP may, at any time and without prior notice, change, suspend or discontinue any content, without this modification resulting in the obligation to compensate any third parties. Changes to the content will take effect after they have been made available on the Webpage.



5. Intellectual Property and Industrial Property


All copyrights and intellectual property rights regarding the contents and the Webpage belong to or are licenced to ACP.


The corporate names, trademarks, logos or any other distinctive signs of ACP reproduced on the Webpage are protected under the legal provisions applicable to industrial property. Reproduction or representation of all or any part of any distinctive signs is strictly forbidden and must be submitted for prior written authorization by ACP or the trademark owner displayed on the Webpage.



6. User Registration


The Wepage join.acp.pt collects name, telephone contact and preferred time of contact of each user who wishes to obtain more information on ACP membership plans described there.


The ACP will use this contact data only and exclusively to contact the user within the services that deserved their explicit request.


The ACP will store this data during the 6-month period. At the end of this period, personal data will be destroyed.



7. Privacy Policy and Cookies Policy


The processing of personal data of users of the Webpage, carried out by ACP, will be in accordance with its Privacy Policy, which can be accessed here.


The use of cookies by ACP on this Website is regulated in the Cookies Policy, which can be accessed here.



9. ACP Warranties and Liability


ACP does not warrant in any way to users that the contents, products or services provided on the Website fulfill or are able to meet their needs and expectations, and/or that any error in the Webpage software will be forcibly corrected. An advice or information made available on the Webpage will not in any way create a guarantee not expressly provided for in these Conditions.


Furthermore, ACP does not warrant that the Contents do not contain inaccuracies, lapses or typographical errors.

Because the Webpage is a public electronic communications network that may be used by various users and may be exposed to web traffic overload, ACP shall not, to the maximum extent permitted by law, be liable to users for:


a) Any damages suffered by users and third parties resulting from the impossibility of using the Webpage and its contents due to delays, errors, suspensions and subsequent loss of information caused by facts outside the control of ACP and that are not attributed to it, namely, any failures caused by third-party communications networks, connection software and any computer viruses;


b) Any damages suffered by users and third parties that may arise from failures to capture, display or use the contents, not due to ACP fault or due to unauthorized use of ACP servers;


c) The correctness, currentness or veracity of the information contained in the contents, as well as any errors, deficiencies or inaccuracies thereof and consequent damages.



10. Miscellaneous


Should any of the provisions of these Conditions be declared void, ineffective, or be annulled, this will not affect the validity or effectiveness of the remaining clauses, which shall remain in full force and effect.


The Portuguese Law shall apply to all matters governed by these Conditions.


In the event of a legal dispute, in the interpretation or application of these conditions, as well as in the construction and execution of agreements entered into through the Webpage, the jurisdiction of the Lisbon district shall prevail, with express waiver of any other.
